Truck driver negligence cited in wrongful death suit

Truck drivers in Fort Bend County are required to follow strict rules in terms of proper care and attention to both their vehicles and other drivers on the road. When these rules are not followed and a truck accident results, severe consequences may follow. A Texas husband and father is pursuing those consequences in a suit claiming truck driver negligence after losing his wife and two children, who died in a head-on collision with an 18-wheeler tractor trailer truck.

The accident occurred in Tucson, Arizona, on Sept. 8. The truck driver was heading eastbound on Interstate 10 when he reportedly lost control of his vehicle and crossed the median, leading him into the oncoming westbound traffic lane. The truck collided with another vehicle, killing the three family members.

The driver said to be responsible for the truck accident has been accused of failing to maintain a proper lookout and failing to avoid the incident in question. In addition, failure to maintain the vehicle and driver inattention is additionally alleged. Further, the driver is accused of failing to take proper evasive action, as well as failing to operate a truck as a reasonable person would do under similar circumstances.

The plaintiff understandably wants all parties responsible held accountable, and has filed suit for negligence against the truck company that employed the driver as well. Sierra Transportation is accused of negligence in hiring and training practices, as well as negligence in supervision and entrustment.

Anyone in Fort Bend County who has lost a family member in a car or truck accident knows the devastation of the experience. Losing three in one accident will surely follow the man for the rest of his life. This suit against Sierra Transportation and the truck driver seeks wrongful death and survival damages for funeral expenses, loss of companionship and society, court costs and significant other claims of loss. Individuals that are left behind as the result of similar tragedies this would benefit from a personal injury lawyer who can assist in the pursuing full accountability for those that caused or contributed to the fatal accident.
