Possible wrongful death? Texas man killed in an accident

Tragedy struck in Texas recently when a seemingly minor car accident turned deadly in Montgomery County on Feb. 22 at about 8:30 p.m. The first collision occurred on FM 105 near McCaleb and appears to have been a minor incident. The news article did not disclose how many vehicles were involved, but after the crash, the driver was said to be sitting in his pickup truck when he was struck by another vehicle. That second collision proved to be fatal as the pickup driver was killed in the accident.

The driver who struck the pickup truck is under suspicion of being intoxicated. No further information was immediately available describing the specifics of either collision or whether the suspected drunk driver was in custody. In any case, the family members of the deceased victim will likely want to learn all of the facts and circumstances surrounding the tragic crash. The emotional toll his death will have on the family is difficult to imagine, and they are now forced to grieve a life cut senselessly short. They may also want to make sure all negligent parties are held accountable for their actions.

Texas law provides for the right of a victim's family to pursue a legal claim of wrongful death. Such an action is appropriate when a fatality occurs through the negligent or reckless conduct of another party. It is a civil action which is in addition to any criminal charges brought for drunk driving or other alleged violations of state laws. While a wrongful death claim can never atone for a life lost, it may help the family by providing financial remuneration to cover medical expenses and other damages. It also may serve as a plea for caution on the roadways in order to avoid serious injuries or even a tragic death such as occurred in Montgomery County.
