2 killed in Texas crash involving suspected drunk driver

A young Texas woman has been accused of killing two people and seriously injuring another in a tragic car accident recently in Montgomery County. The potential wrongful death of the two people resulted after the woman apparently was driving drunk and struck a car carrying three people. A 19-year-old victim and a back-seat passenger were killed. Another passenger, 21, was taken to a local hospital and was listed in critical but stable condition.

The crash occurred right before 4 a.m. on the North Freeway close to Highway 242. Witness reported the woman's erratic driving and said she was driving on the wrong side of the road. However, before police could respond and intercept the woman, she had already crashed into the car.

The 23-year-old suspected drunk driver in this accident was also injured and transported to the hospital. She has since been charged with one count of intoxication assault and two counts of intoxication manslaughter.

Although the woman is now facing criminal charges, the families of the two deceased victims, as well as the seriously injured passenger, likely have other legal recourse to attempt to ensure she is held fully responsible for her actions. As they are grieving, they may have unanswered questions about exactly what occurred and what rights they have under Texas law to do something about it.

A wrongful death claim is appropriate under state law when a fatality occurs due to the negligent or intentional act of another. While it remains to be seen if the families wish to pursue these claims, or if the injured victim wants to file a personal injury claim, one thing is for certain: the lives of many people were inalterably changed in the tragic and seemingly senseless wrong-way fatal crash.
