Texas family wins judgment in wrongful death case

When someone dies in an act caused by another, criminal charges may follow against the person. However, that doesn't always mean a conviction will be secured. If this happens, families can often be left with a sense of shock, but it doesn't mean they are out of options. One Texas family lost their son, and when no indictment was issued against the man believed to be responsible, they sought justice in the form of a wrongful death lawsuit.

The incident occurred in 2007 when two men died in what authorities have called a drug deal gone wrong. Officers believe the 27-year-old accused acted in self defense when he shot both of them. At the time of the shootings, authorities believe the two men were attempting to rob him. After the man avoided criminal charges, the parents decided to take civil action.

The man's father claims the justice system failed them, and they filed the wrongful death lawsuit in hopes it would earn them the justice they felt they deserved. The civil court ruled in their favor and entered a judgment against the man for $800,000. He has yet to pay the family any money; however, he is said to return to court to plan out how the payments are to be made. They say the amount of money they were awarded was miniscule in terms of what was taken away from them.

When a Texas family feels like the criminal courts have not handed down the judgment they feel is deserved, they can matters into their own hands by filing a wrongful death lawsuit. Such a lawsuit could end in a monetary award and act as an additional measure of justice. Although it won't change their loss, it could offer a small solace to families who have suffered so much.
