Pursuing damages in an 18-wheeler accident

Semi trucks pose unique hazards on Texas highways due to their size and weight. When a large 18-wheeler is involved in a collision with a smaller passenger vehicle, the results are often devastating injuries or death. In these situations, victims and their families need the best legal representation they can get.

Pursuing a claim arising out of an 18-wheeler accident requires experience and skill over and above that required in an ordinary automobile accident case. Truck drivers and trucking companies are subject to a variety of state and federal regulations, and understanding how these apply in a particular case is critical.

State and federal trucking regulations are comprehensive. Loads must be properly secured. Semi trucks must undergo regular inspections to ensure lights, brakes and tires are in good condition. Drivers are subject to limitations on how many hours they can drive between rest periods. Truckers are required to keep a trucking log to verify their compliance with these rules. Drivers are also subject to periodic drug and alcohol testing. They must have a valid commercial driver's license to drive trucks over a certain weight.

When an accident is caused by truck driver negligence or violation of one of these regulations, victims have the right to compensation. An injured victim can sue for medical expenses, loss of income, disability, disfigurement and pain and suffering. In a fatal accident, the victim's next of kin can bring a wrongful death lawsuit and recover damages.
