Houston pedestrian struck and killed by alleged drunk driver

Drunk drivers are a leading cause of death and serious injuries in the greater Houston area. In what appears to be the latest tragic example, a 74-year-old man was struck by a car and killed while walking across a road in Houston on New Year's Eve. The driver has been charged with DWI and driving without a valid driver's license.

According to the Houston Police Department, the 22-year-old driver was proceeding eastbound in the 10100 block of Kempwood in a Honda Accord when the victim attempted to cross the roadway. Police say the victim was not in the crosswalk when the accident occurred. He was declared dead at the accident scene. Police detained the driver of the Honda and concluded he was intoxicated.

When a loved one is killed in a drunk driving accident, the loss can be devastating for a family. Texas law allows victims to bring a wrongful death lawsuit and recover damages for funeral expenses, loss of financial support and loss of care, comfort and companionship. In a drunk driving accident, punitive damages may also be recoverable. Any damages recovered are apportioned by the jury among those family members who are entitled to recover.

The personal representative of the decedent's estate can also bring a survival action against the defendant. A survival action is separate from the wrongful death action and is essentially a personal injury action which the decedent could theoretically have brought before death. Damages in a survival action can include medical expenses and the victim's pain and suffering. Any damages recovered are paid to the victim's estate and distributed to heirs under the Texas intestacy laws or according to the terms of the victim's will.
