An aggressive approach for pedestrian accident victims

A pedestrian who is struck by a motor vehicle will often suffer serious injury, if not death. The human body is simply no match for a ton and a half of steel moving at speeds of 30 or 60 miles per hour. A victim who survives a pedestrian accident may suffer a severe brain injury or be left permanently disabled, even paralyzed. Many victims require extensive long-term care.

Proving that the driver was at fault is not always a simple matter in a pedestrian accident case. As we discussed in last week's post, pedestrians do not always have the right of way in Texas. Nonetheless, a driver can still be found negligent for failing to see a pedestrian or failing to stop in time, even if the pedestrian did not have the right of way.

As in any motor vehicle accident case, it is essential to locate and interview all witnesses as soon as possible. In serious injury or death cases, an accident reconstruction expert may be retained to examine the accident scene, measure skid marks and analyze damage to the vehicle in order to render an opinion as to fault.
