When is a property owner liable for a slip-and-fall in Texas?

Slipping and falling on a wet or uneven surface is something that has happened to all of us. Usually the incident is often a cause for nothing more than slight embarrassment. But, sometimes slip-and-falls can lead to serious injury, or even death. Many falls are the result of unsafe conditions on property. If the accident was one which the property owner could have prevented, Texas law will allow a claim for compensation by the injured party or, in the case of a fatal accident, a wrongful death claim by surviving family members.

Whiplash from a car accident can be a serious injury

Whiplash is an injury that occurs when a person's head is violently thrown back and forwards. The rapid motion can cause damage to the spine, muscles, ligaments and nerves in the neck. The soft disks between neck vertebrae can also be damaged. Rear-end car accidents are the most common cause of whiplash injuries.

Holding automakers liable for automobile design defect injuries

Texas residents have probably become used to news stories about automobile safety recalls. As we reported in a recent post, recalls by automakers have hit record levels this year. Many of these recalls were prompted by accidents that resulted in serious injury or death. For the victims of these accidents, the recall notice comes too late.

What is the role of the FDA in a product recall?

When a product that is regulated by the U.S. Food & Drug Administration is discovered to be defective or to present a health risk, the first notice the public receives of the problem is often the announcement of a product recall. The FDA has broad authority under federal law to regulate the safety of prescription drugs, medical devices, cosmetics and most of the food products consumed in the U.S.
