Texas is among the 10 worst states for fatal semi truck accidents

As we discussed in a recent post, it's important to exercise caution when driving in the vicinity of a big 18-wheeler on a Texas highway. But, even the most cautious driver can be injured or killed in an accident caused by a negligent or inattentive truck driver.

Recent data from the National Highway Traffic Safety Administration shows that nationwide there were 3,806 fatal truck accidents resulting in 4,251 deaths in 2013. Due to the size and weight difference between a semi truck and a passenger vehicle, 83 percent of the deaths were of people in smaller vehicles, or motorcyclists, pedestrians or bicyclists. Only 17 percent of the deaths were of occupants of the semi truck.

The NHTSA data also showed that 50 percent of the truck accident fatalities occurred in just 10 states. One of these states was Texas. The others were New York, Pennsylvania, Ohio, Indiana, Illinois, California, North Carolina, Georgia and Florida. A spokesperson for the Federal Motor Carrier Safety Administration noted that if fatal truck accidents could be reduced just 10 percent in those states, more than 200 lives a year could be saved.

When a loved one is killed in a semi truck accident caused by truck company or truck driver negligence, surviving next of kin have the right to bring a wrongful death lawsuit and recover compensation for their loss. Damages are recoverable for loss of companionship, loss of financial support, funeral expenses and final medical expenses. In addition, the victim's estate can sue for damages in a survival action.
