The act enables them, or, if they die, their family members, to bring a lawsuit against their employer if they are able to prove that their death or injury has been caused by the negligence of the ship's operator, owner or other members of the crew. A lawsuit may also be filed if:
- The ship itself can be proven to be unseaworthy or unsafe
- The ship or its systems are defective
- The ship is not maintained properly
