Truck Crashes Cause Great Losses in our Community

The Richmond-Rosenberg area, and Fort Bend County as a whole, have been the site of tragic truck crashes. Many of these involve 18-wheelers traveling along U.S. 59 and U.S. 90, causing extreme suffering and endangerment to Richmond-Rosenberg locals. 

July 2021:
A Tragic Death on U.S. 59

The owner of Richmond's beloved community garden center The Enchanted Forest of Richmond was killed in a fiery crash involving an 18-wheeler commercial truck. This tragic car accident happened around 7 a.m. on U.S. 59 and Grand Parkway, shocking the victim's family and colleagues at The Enchanted Forest of Richmond. Two elements of this disaster are very representative of car accidents involving commercial trucks in our area: first, despite both vehicles erupting into flames, the 18-wheeler driver walked away unscathed; second, the crash occurred on U.S. 59.

Are High-Risk Thoroughfares

U.S. 59 is a highway that travels through seven states and extends all the way from the U.S.-Mexico border in Laredo all the way up to the U.S.-Canada border. U.S. 90 ALT passes through Richmond-Rosenberg, and is an alternate route to U.S. 90, which goes through San Antonio and Houston all the way to Louisiana. The length of these highways and the fact that they pass through multiple major delivery points means they bring many truck drivers through the Richmond-Rosenberg area who are delivering goods to us, as well as communities several states away.

Meanwhile, many of us have to use these highways to get to work and meet other needs, which means we face risks of being involved in truck accidents while traveling from Richmond-Rosenberg to other parts of Texas. In May 2022, an 18-wheeler crash blocked every lane of U.S. 59 north of Loop 287, and was so severe that it required the use of a medical helicopter. In June 2022, an 18-wheeler driver near U.S. 90 was cited for ignoring a no-thru traffic sign, getting stuck on the railroad tracks and causing a train to strike the truck, endangering the train engineer and his passenger.

Crashes Are Tragically Common in the Richmond-Rosenberg Area

The Texas Department of Transportation reports that in 2020, Richmond-Rosenberg had a total of 1,034 auto accidents, which resulted in four fatalities. This equates to an average of more than two auto crashes or truck accidents every single day in Richmond-Rosenberg.

There was at least one Texas roadway fatality every two hours and 15 minutes in 2020, with over 500 of these deaths occurring in head-on collisions. In total, Texas saw 14,660 people suffer auto injuries in 2020. The United States Census Bureau reported that the Houston metro area gained more residents from July 2020 to July 2021 than all but two other major American metro areas. Over the prior decade, Fort Bend County actually added more residents than Houston did.

Statute of Limitations

Statute of limitations laws create time limits for filing a lawsuit. The deadline varies depending on the type of lawsuit, and the state it is to be filed in. In Texas, you have two years from the date of your truck accident to file a personal injury lawsuit. This is the type of lawsuit we would file if you suffered harm in a crash. If, tragically, you lost a loved one in a truck accident, we could file a wrongful death lawsuit. The deadline for filing a wrongful death suit in Texas is two years from the date the victim passed away. 

LEGAL PAPERWORK

Types of Damages

There are two key types of damages in truck accident lawsuits. Compensatory damages are the more common form. These are awarded to compensate people directly for the injuries and harms they suffered as the result of another's actions or negligence.  Exemplary damages (often called punitive damages) are rarely awarded. Exemplary damages are awarded in cases where the liable party acted in an especially egregious manner, and they are intended to punish that party for their actions.

Modified Comparative Negligence

Sometimes, people do not pursue a lawsuit when they should because they believe they were partially at fault for the accident. Texas is a modified comparative negligence state. This means you can receive financial compensation for your truck accident injuries, medical costs and more, even if you are partially responsible for causing the crash. The key determination our attorneys have to prove is if another driver or party was more responsible for the accident than you were. For example, if you are found to be 10% responsible, and total damages are $10,000, you could collect $9,000.
