Truck Crashes Cause Great Losses in our Community
A Tragic Death on U.S. 59
The owner of Richmond's beloved community garden center The Enchanted Forest of Richmond was killed in a fiery crash involving an 18-wheeler commercial truck. This tragic car accident happened around 7 a.m. on U.S. 59 and Grand Parkway, shocking the victim's family and colleagues at The Enchanted Forest of Richmond. Two elements of this disaster are very representative of car accidents involving commercial trucks in our area: first, despite both vehicles erupting into flames, the 18-wheeler driver walked away unscathed; second, the crash occurred on U.S. 59.
U.S. 59 & U.S. 90
Are High-Risk Thoroughfares
U.S. 59 is a highway that travels through seven states and extends all the way from the U.S.-Mexico border in Laredo all the way up to the U.S.-Canada border. U.S. 90 ALT passes through Richmond-Rosenberg, and is an alternate route to U.S. 90, which goes through San Antonio and Houston all the way to Louisiana. The length of these highways and the fact that they pass through multiple major delivery points means they bring many truck drivers through the Richmond-Rosenberg area who are delivering goods to us, as well as communities several states away.
Meanwhile, many of us have to use these highways to get to work and meet other needs, which means we face risks of being involved in truck accidents while traveling from Richmond-Rosenberg to other parts of Texas. In May 2022, an 18-wheeler crash blocked every lane of U.S. 59 north of Loop 287, and was so severe that it required the use of a medical helicopter. In June 2022, an 18-wheeler driver near U.S. 90 was cited for ignoring a no-thru traffic sign, getting stuck on the railroad tracks and causing a train to strike the truck, endangering the train engineer and his passenger.
Crashes Are Tragically Common in the Richmond-Rosenberg Area
The Texas Department of Transportation reports that in 2020, Richmond-Rosenberg had a total of 1,034 auto accidents, which resulted in four fatalities. This equates to an average of more than two auto crashes or truck accidents every single day in Richmond-Rosenberg.
This problem affects the whole state of Texas. There was at least one Texas roadway fatality every two hours and 15 minutes in 2020, with over 500 of these deaths occurring in head-on collisions. In total, Texas saw 14,660 people suffer auto injuries in 2020. If you or your loved one has been injured on the roadways due to another party's negligent actions, our truck accident lawyers are here to help. We want you to receive the financial compensation you deserve instead of bearing the fallout of another party's negligence.

The Fort Bend Boom May be Leading to More Crashes
The United States Census Bureau reported that the Houston metro area gained more residents from July 2020 to July 2021 than all but two other major American metro areas. Over the prior decade, Fort Bend County actually added more residents than Houston did.
A total of 233,000 new people have moved to Fort Bend between 2010 and 2021. This has led to increased traffic in Richmond-Rosenberg and surrounding areas from commercial trucks, which increases the risk of truck accidents and other kinds of auto collisions. When the demands of a growing community intersect with human error on the road, the results can be devastating. Our firm is dedicated to helping innocent victims rebuild their lives after an accident.

Why You Should Hire
Some people who suffer in truck accidents may think they can handle the situation themselves, or take the first offer given by the liable party's insurance company. This can be a serious mistake and may lead to you receiving significantly less financial compensation than you deserve. The insurance company's goal is to minimize what you are paid. But our attorneys work to protect your rights, help you afford medical care and make sure you collect the most money possible. You need an attorney to make certain justice prevails over an insurance company's bottom line.
What You Can do to Help Yourself
Our attorneys work to take the burden off of your shoulders throughout your case. At the same time, it can be empowering to know that there are actions you can take to help yourself following an accident involving a large truck or any other kind of commercial vehicle. These include:
Attend Medical Appointments
You may feel like you can turn down medical care, especially if you do not feel you have suffered serious physical harm. This can be a big mistake. Injuries caused by truck accidents can often remain hidden for some time following a crash. Even a seemingly minor injury can spiral out of control, and end up negatively affecting you long after you are legally eligible to file suit. The primary reason you should seek medical care now is to safeguard your own health. Attending regular doctor's appointments can also help our lawyers build your case and seek the amount of restitution you truly deserve. The medical bills and medical records related to doctor's appointments are solid proof we can use in disputes with trucking companies, insurance companies and other driver's attorneys. Alternatively, a lack of doctor's visits may be presented as proof that you were never really harmed in your truck accident.
Hard evidence can help us prove your case and attain the maximum compensation possible. Photos you may have taken at the scene of the accident, as well as contact information from any witnesses, can be very important. All too often in this digital age, people keep all information on their cell phone, or a single computer. It is impossible to predict when these devices can get lost or broken, which may cause you to lose your evidence forever. You can ensure you always have access to your evidence by taking a few simple steps. Sending emailed copies to yourself will give you the ability to pull up your proof on any digital device, and forward it to our attorneys when needed. Another step is to back up your information on several different devices. Finally, printing out hard copies is another great option.
An accident involving a large truck can be disorienting, if not traumatizing. When accidents happen, it can feel natural to want to apologize, even if you're not sure if you are at fault. This is never the correct decision. You should not admit fault in any way, shape or form. Apologizing does nothing to help the situation, and can be portrayed as an admission of guilt by a trucking company's legal representatives. A simple "sorry" can easily be construed as accepting responsibility for causing the accident. You should also avoid speaking about your accident on social media. Posts you make about the crash may be used against you by opposing attorneys as evidence of your guilt. The short-term relief of an apology or sharing your experience on social media is not worth losing the financial compensation you and your family need and deserve.
Dealing With Insurance
The number-one rule for dealing with insurance companies is to direct any and all questions to your attorneys. Our team at Reed & Terry has handled many truck accident cases and knows what should or shouldn't be said.
We also know that insurance companies are not on your side, and that they may pressure you into poor decisions. These can include accepting small settlements and making statements that can be taken out of context.

Legal Basics You Should Know
Statute of Limitations
Statute of limitations laws create time limits for filing a lawsuit. The deadline varies depending on the type of lawsuit, and the state it is to be filed in. In Texas, you have two years from the date of your truck accident to file a personal injury lawsuit. This is the type of lawsuit we would file if you suffered harm in a crash. If, tragically, you lost a loved one in a truck accident, we could file a wrongful death lawsuit. The deadline for filing a wrongful death suit in Texas is two years from the date the victim passed away.
Types of Damages
There are two key types of damages in truck accident lawsuits. Compensatory damages are the more common form. These are awarded to compensate people directly for the injuries and harms they suffered as the result of another's actions or negligence. Exemplary damages (often called punitive damages) are rarely awarded. Exemplary damages are awarded in cases where the liable party acted in an especially egregious manner, and they are intended to punish that party for their actions.
Modified Comparative Negligence
Sometimes, people do not pursue a lawsuit when they should because they believe they were partially at fault for the accident. Texas is a modified comparative negligence state. This means you can receive financial compensation for your truck accident injuries, medical costs and more, even if you are partially responsible for causing the crash. The key determination our attorneys have to prove is if another driver or party was more responsible for the accident than you were. For example, if you are found to be 10% responsible, and total damages are $10,000, you could collect $9,000.
What If a Defective Part Caused Your Accident?
Auto parts makers are responsible for making sure that the products they sell to the public are safe to operate. Unfortunately, the producers of these parts do not always live up to this expectation. They may make roadways dangerous by failing in the design phase, manufacturing process and other stages that take place between the drawing board and the product being used by consumers. When a parts manufacturer has failed, they can be held liable in a defective products lawsuit. Examples of defective products that can lead to truck crashes are faulty braking systems and dysfunctional steering wheels.
Without a widely publicized recall or media attention regarding a particular defective part, it can be difficult to know if your accident was caused by a defective auto part. Our attorneys may be able to utilize our network of experts to investigate whether a defective product was the cause of your particular accident. If it is, we can draw on our decades in practice to fearlessly fight major auto part manufacturers and collect the compensation you deserve.
